THE FOLLOWING SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OF AGE AND OLDER. VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW. THIS SWEEPSTAKES WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

  1. 1. HOW TO ENTER: Sweepstakes starts on November, 19, 2007 at 12:00:01 a.m. Eastern Standard Time ("EST") and ends on December 19, 2007 at 11:59:59 p.m. EST (the “Promotion Period”). To enter, visit acehardware.com (the “Website”) during the Promotion Period and create or modify an online wish list of products available at acehardware.com. Entries will not be acknowledged. Limit one entry per person and per email address. No person may use more than one e-mail address to participate in this Sweepstakes, and any attempt to participate otherwise will be deemed to be an abuse of the Sweepstakes and will result in ineligibility to participate in or win this Sweepstakes. Any entries not in conformance with these Official Rules will be disqualified.
  2. 2. DRAWING: On or around December 28, ten (10) entries will be selected in a random drawing from among all eligible entries received ("Potential Winners"). The drawing will be conducted by Ace Hardware Corporation (“Sponsor”) whose decisions shall be final and binding in all matters pertaining to this Sweepstakes. Potential Winners will be notified via e-mail within approximately ten (10) days of drawing date.
  3. 3. PRIZE (10 Grand Prizes): Ten (10) winners ("Winners") will receive a Five Hundred Dollar ($500) promotion code to be used toward the purchase of any products available on acehardware.com. Prize must be redeemed in a single transaction on acehardware.com by December 31, 2008. Prize is not redeemable for cash, nor is it transferable or substitutable. Prize cannot be used toward tax or shipping expenses. All expenses, including all federal, state, and local taxes, are solely Winner's responsibility. Prize will be delivered to each Winner via email. Odds of winning depend upon the number of eligible entries received. Approximate Retail Value of all prizes: $5,000.
  4. 4. ELIGIBILITY: This Sweepstakes is open to legal residents of the 50 United States of America and the District of Columbia, who are 18 years of age or older at the time of entry. Employees, officers and directors of Sponsor and/or of Ace retailers and/or GSI Commerce Solutions, Inc. (and members of their respective immediate families; defined as spouses, parents, children and siblings whether biological, adoptive, step or in-law; and persons living in the same households) are ineligible to participate. Limit one prize per household. The Potential Winners will be notified by e-mail (“Prize Notification”) and will be required to provide certain information, e.g., complete name, mailing address, date of birth, and day time phone number by return e-mail within three (3) days of date Prize Notification is sent or prize will be forfeited. Potential Winner will be required to sign and return an Affidavit of Eligibility/Compliance & Liability/Publicity Release (where legal) (“Winners’ Documents”) releasing Sponsor, Ace retailers, their parent, affiliate and successor companies and assigns and such entities’ employees, officers, directors and agents (“Sponsor Parties”) from any liability in connection with the Sweepstakes or the prize including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether to person or property, including death, arising out of or resulting from, whether directly or indirectly, the acceptance, enjoyment, use or misuse of any prize or merchandise purchased with such prize. If prize is won by an eligible minor, prize will be awarded to the Potential Winner’s parent or legal guardian who must sign all required documents on Potential Winner’s behalf. The original Winners’ Documents must be signed, notarized and original versions must be received by Sponsor via regular postal mail or other carrier within twenty-one (21) days of date sent by Sponsor or prize will be forfeited. Sponsor is not responsible for late, lost, incomplete or misdirected Winners’ Documents. If Prize Notification, Winners’ Documents or prize is returned as undeliverable, prize will be forfeited and, in the event of prize forfeiture for any reason, an alternate Potential Winner may, at Sponsor’s sole discretion, be selected. All prizes properly claimed will be awarded.
  5. 5. GENERAL: By participating in the Sweepstakes, entrants agree to these Official Rules and the decisions of Sponsor which are final and binding in all matters and all respects relating to this Sweepstakes.

    For the purpose of the Sweepstakes entry, entrant will be the e-mail address associated with the wish list at the time the qualifying sweepstakes entry is created. In case of dispute as to the personal identity associated with the e-mail entrant, the entry will be deemed made by the authorized account holder of the e-mail address associated with the wish list. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method are ineligible and will be disqualified.

    Entering the Sweepstakes constitutes permission to use Winner's first name, last initial, city and state of residence for posting of Winners on the Website without additional compensation, except where prohibited by law. Acceptance of prize constitutes permission to use Winner's name, photograph, videotape or other likeness, address, voice and/or statements for advertising/promotion purposes as Sponsor so determines without additional compensation, except where prohibited by law. By entering, entrants acknowledge that Sponsor Parties have neither made, nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prizes. By entering, entrants agree that Sponsor Parties are not responsible for and are hereby released from any liability with respect to (i) any and all claims, losses, actions, damages or other liability, whether actual, incidental or consequential, arising out of or relating to his/her participation in this Sweepstakes and/or the acceptance, possession, use or misuse of any prize or merchandise purchased with such prize; (ii) interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Sweepstakes. Sponsor Parties are not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human errors which may occur in the processing of the entries in this Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. All materials submitted become the property of Sponsor. If in the judgment of Sponsor, the Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of any Sweepstakes, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Sweepstakes.

    Any personally identifiable information collected during your participation in this Sweepstakes will be collected by Sponsor or third parties on behalf of Sponsor. Such information will be used by Sponsor Parties for purposes of the administration and fulfillment of the Sweepstakes and in accordance with Sponsor’s posted Privacy Policy.

    This Sweepstakes is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the State of Illinois. Any and all disputes will be resolved in the appropriate courts in the State of Illinois exclusively, and subject to the laws of the State of Illinois. Should there be a conflict between the laws of the State of Illinois and any other laws, the conflict will be resolved in favor of the laws of the State of Illinois.
