The "Ace YardRx New Customer Hose" Promotion
Terms and Conditions

2,000 Garden Hoses Available. AVAILABLE WHILE SUPPLES LAST. The "Ace YardRx New Customer" Promotion (the "Promotion") begins on or about June 4, 2025 at 12:01 a.m. Central Time ("CT") and ends on the earlier of (i) when the "Cap" (as defined below) is achieved; or (ii) June 30, 2025 at 11:59 p.m. CT (the "Promotion Period"). This Promotion organized by Ace Hardware Corporation, 2915 Jorie Blvd, Oak Brook, IL 60523 ("Ace Hardware"). During the Promotion Period, Ace Hardware will provide one (1) Fitt HiFlo 100 ft. L Medium Duty Commercial Grade Lightweight Garden Hose (the "Garden Hose") to the first Two Thousand (2,000) users who sign up for an Ace YardRx subscription of $200.00 or more for the first time (the "Cap"). Limit one (1) Garden Hose per person. Recipients are scheduled to receive the Garden Hose with their first Ace YardRx shipment. Participating in this Promotion is also subject to Ace Hardware's Terms of Use (available at: https://www.acehardware.com/customer-service?page=terms-of-use), which are incorporated herein by this reference.

The Promotion is open only to legal residents of the forty-eight (48) contiguous United States and Washington, D.C., who are physically located and residing therein (excluding Alaska, Hawaii, Puerto Rico and all other U.S. territories and possessions) who are new Ace YardRx customers (i.e., customers who do not have, and have not had in the past, an Ace YardRX subscription). Each participant must be at least eighteen (18) years of age at the time of entry. Personal information you provide to Ace Hardware will be processed in accordance with Ace Hardware's privacy policy; the privacy policy for residents of the United States is located at: https://www.acehardware.com/privacy.

The total approximate retail value of each Garden Hose is Sixty-Nine Dollars and Ninety-Nine Cents ($69.99). Any applicable taxes are the sole responsibility of each recipient. No substitution or transfer of a Garden Hose is permitted. Garden Hoses cannot be redeemed for cash. Garden Hoses are not returnable and will only be delivered to an address in the continental United States. Garden hoses pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Promotion materials are for illustrative purposes only. Actual Garden Hose(s) may vary from the Garden Hose(s) pictured. All details and other restrictions of the prize(s) not specified in these terms will be determined by Ace Hardware in its sole discretion. Ace Hardware reserves the right in its sole discretion to substitute Garden Hose(s) of comparable value if any Garden Hose listed is unavailable, in whole or in part, for any reason.

Ace Hardware (A) shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or from entrants' acceptance, receipt, possession and/or use or misuse of the Garden Hose, and (B) has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Garden Hose, including, without limitation, to such Garden Hose's quality or fitness for a particular purpose. Garden Hose will only be delivered to addresses in the United States.

Ace Hardware reserves the right to implement policies and procedures as may be necessary to enforce compliance with these Terms. Ace Hardware reserves the right to modify, extend, suspend, or terminate the Promotion if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Ace Hardware's reasonable control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion as contemplated herein. If Ace Hardware is prevented from distributing the Garden Hoses or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, provincial, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Ace Hardware's control (each a "Force Majeure" event or occurrence), then Ace Hardware reserves the right to modify, suspend, or terminate the Promotion.

Ace Hardware assumes no responsibility for any malfunctions, errors or failures that are human or technical in nature. Without limiting the generality of the foregoing, Ace Hardware is not responsible for miscommunications, or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Ace Hardware reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Terms, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person.
